DECLARATION OF TRUST

THIS DECLARATION IS MADE AND EXECUTED IN PATNA, BIHAR (INDIA) on the 30th Day of JULY 2018 by GHAZANFAR ALI KHAN S/O LATE ABDUL HAMID KHAN Resident of HOUSE NO–403, SHIVAM RESIDENCY, MAURYA PATH, KHAJPURA, PATNA – 800014 (BIHAR) and citizen of INDIA, who is the SETTLER OF THE TRUST which expression shall, unless excluded by or repugnant to the context, be deemed to include his executors, administrators and representatives.

AND WHERE AS THE SETTLER has declared a sum of Rs 50,000/- (Rupees Fifty Thousand only) possessed by him to be TRUST property for the Educational, Medical, Social, Charitable and Economic Development for the people of INDIA with special attention on the Minorities, Weaker Section and Backward Section of the Society with the aims and objects noted below in clauses. Besides above declared amount there is no any other property vested in the Trust at this time.

AND WHERE AS FOR the control of management and dealing with the affairs of the TRUST, he has constituted BOARD OF TRUSTEES with their perpetual succession: –

  1. NAME OF THE SETTLER: – GHAZANFAR ALI KHAN S/OLATE ABDUL HAMID KHAN.
  • THE NAME OF THE TRUST: -The Name of the TRUST shall be “Hind Life and Education Trust (HLET).
  • THE CORPUS OF THE TRUST: – The corpus of the TRUST shall be Rs 50,000/- (Rupees Fifty Thousand only).
  • THE OFFICE OF THE TRUST: -The Head Office of the TRUST shall be at HOUSE NO – 403, SHIVAM RESIDENCY, MAURYA PATH, KHAJPURA, PATNA – 800014 (BIHAR) under the jurisdiction ofPS – Shastri Nagar and branch offices can be opened in any part of India.
  • THE TRUSTEES OF THE TRUST: The said Settler of the TRUST has appointed the following persons as members of the First BOARD OF TRUSTEES to manage the affairs of the TRUST.

The management and control of the TRUST and TRUST properties shall vest in the BOARD OF TRUSTEES. The BOARD OF TRUSTEES shall comprise not less than 3 (Three) and there will not be any upper limit, including the President, Secretary and Treasurer.

The TRUSTEES will be entitled to receive specific subscription from any person belonging to any religion, caste or creed who accepts the aims and objects and agrees to abide by rules and regulations of the TRUST and to admit such person as defined in Bye laws. Hereinafter “SETTLER and TRUSTEES” jointly referred to as “BOARD OF TRUSTEES” which expression shall unless excluded or repugnant to the context, be deemed to include the TRUSTEE or TRUSTEES for the time being of these presently and their successors in office.

And whereas if the TRUSTEES desires to co-opt other eminent personalities as TRUSTEES for betterment of TRUST, they can co-opt.

And whereas if vacancies made in BOARD OF TRUSTEES, these vacancies can be fulfilled by co-option.

6. AIMS AND OBJECTS OF THE TRUST:

The Organization will render service for the welfare and development of common people of India irrespective of their caste, creed, religion, language, sex or other discriminating factors by providing a common platform for Education, Medical, Social, and Economic Development, legal and environmental advancement of people of India and in particular the Minorities, Weaker Section and Backward Section of the Society in need for the activities mentioned below: –

  1. To set-up, administer, establish, run, maintain and manage institutions like Schools, Colleges, Universities, Educational Training Colleges, Management Colleges, Technical and Engineering Colleges, Polytechnic Colleges, Inter Colleges, Degree colleges, Medical, Dental & Para Medical Colleges, Mass Communication College, Journalism College, Film Academies, Television Training Centers, Educational Research Centers, Industrial Training Centers, other Vocational, Professional and Technical centers etc., and to obtain recognition from Governments and other Authorities as required.
  • To set-up, establish, run, administer, maintain and assist Medical College Hospital, Medical Research Centers, Charitable Dispensaries, Charitable Hospitals, Dispensaries, Nursing College/Training Centers, Charitable Ambulance Services, Maternity Homes, Old Age Home, Children Welfare Centers, Charitable Orphanage, Convalescent Homes, Sanatorium, Musafir Khana and other similar institutions or centers for rendering or providing education, medical relief or services to needy and poor person of the society and for public at large.
  • To work for the affordable and easily available higher education to the people in general and to the students belonging to the weaker section of the society especially the students of such category among the minority communities in particular.
  • To establish, run and maintain training, vocational, coaching institutes being equipped with Book Banks, Libraries and Reading Rooms including Hostel or living facility to help and assist promising students belonging to the weaker section of the society or the minority communities in preparing for various competitive examination like Public Service Commissions, Staff Selection Commission, IIT, MBA, Banking, Railways, and other such competitive examinations.
  • To undertake and run the integrated programme on street children rehabilitation, juvenile justice, adoption resource, agency, social defense, civil defense, old age home/multi service center, treatment and rehabilitation of addicts, persons with disabilities, coaching and allied assistance, construction of hostel building and other infrastructure for complete rehabilitation center, vocational training centers, women empowerment, animal welfare, stop prostitution, eradication of poverty.
  • To work for making Primary Education System more meaningful and compatible to the modern day challenges and requirement so that the primary educated students may not be lagging behind. Further, to establish and organise training and orientation classes for the Primary teachers to get them equipped with the contemporary system of education also.
  • To establish, institutions to promote the linguistic and cultural identity of different sections and minorities of India. To promote the education and training of people of all ages and faiths living in to develop their intellectual, physical, economic and spiritual capacities. In so doing to promote equal opportunities, good communities relations and religious tolerance. To promote or carry out research, to provide advice, to publish or distribute information, to cooperate with other bodies, to support, administer or set up other charities.
  • To organize education/learning and knowledge oriented Conferences, Seminars, Symposiums and Workshops of various levels and on different issues. 
  1. To establish liaison and develop mutual assistance and co-operation with different organization of state/Regional/National/International level, whether it is voluntary or governmental institution or a social group or association in furtherance of the aims and objects of the Trust to take steps to eradicate illiteracy and spreading education.
  • To introduce and organize Award giving programme to recognize and honour the remarkable and commendable works or contributions being done by contemporary Educationists, Scholars, Scientists, Poets, Literary Personalities, Economists, Journalists,  Writers in the field of education, media and learning.
  • To work for the eradication of illiteracy and ignorance among the masses in general and among the minority communities in particular with special thrust upon the girls by promoting and spreading elementary and primary education through such educational institutions
  • To carry out the entire programme for the relief, rehabilitation, welfare and development of women in destitute, old-aged, handicapped, street children and child labour, widow, orphan, beggar, sex-worker, Minorities, schedule caste, schedule tribes, backward and other under privileged people.
  • To establish, run and maintain Research & Development, Training & Management Centre to undertake such activities in the field of Agriculture, Floriculture, Horticulture, Poultry farming, Dairy farming Fisheries etc. to boost the rural economy besides the educational activities among the students of farming sectors.
  • To organize, arrange and provide financial assistance, Aid, Scholarship, stipend, Loan to the meritorious students under various categories such as Poor/Under privileged,  Handicapped or physically challenged, female, SC/ST and minority students.
  • To carry out all the programmes/projects for the awakening of national integration, communal harmony, co-operation and cooperative behavior attitude development, moral and social habit development in the youth and to ensure participation in the development of nation and humanity.
  • To work for the eradication of Polio, control of HIV / AIDS conservation of environment and prohibition and de-addiction of tobacco and drug abuse.
  • To Encourage, promote or develop alternative system of medicine i.e. Homeopathy, Polypathy, Ayurveda, Yunani, Yoga, Naturopathy, Meditation, Acupressure, Acupuncture etc. Also promote preventive and curative health services.
  • To organize and install infrastructure for the promotion of sports, Yogas, meditation among youths.
  • To organize or run the programme for the development of culture, tourism, open hotels and national memorials, natural resources management, a forestation and eco-development, environment education, environmental information system, technology upgradation/ establishment/ modernization of food processing industries, quality assurance, market survey, test marketing & brand promotion, gender issues, promotion of blood, eye and human limbs donation subject to Government Rules and Regulations, promotion of Indian languages, prevention of atrocities on rural energy programme, bio-gas development programme, khadi & small scale industries promotion.
  • To undertake, organize, investigate, participate, sponsor, conduct, the Human Right Programme including awakening of human rights, preservation of fundamental rights, Protection preservation of fundamental rights, Protection and safeguards to the victims of human rights, violations, for the freedom, dignity and peace of people. Also undertake case study, research, publications, treaties, with national and international institutions and foundation or endowment of award and prize, for effective implementation of Human Rights.
  • To organize or conduct the programme on International peace, justice and co-operation, interchanges & interaction, legal aid and protection, awareness and consciousness building against social evils, social crime, community-based rehabilitation programme, fighting corruption and restructuring, labour issues, value added and sustainable programme, consumer education and protection etc
  • To do and undertake various study and research projects to furnish and forward recommendations being based upon the new, current and relevant findings, to the concerned ministries of the Central/State Govt. in India, or to any other agency or authority.
  •  To honour the distinguished personalities from various walks of life with honorary rewards and also to distribute prizes to students for outstanding performance in various academic or competitive examinations.
  • To rehabilitate child labour and to run educational institutions / vocational training centers for them.
  • To propagate against feticide and child labour and to strive to restore the basic rights of children, old age people especially elderly parents and women. Further, to run all the programme related with the welfare of women “Beti Bachao Beti Padhao”.
  • To provide Social Services to rehabilitate and assist the handicapped and crippled and to provide assistance to displaced persons.
  1. To strive against the problem of homelessness. The trust shall work for developing/constructing/obtaining home for such homeless people.
  • To organize Seminars, Meet, Conferences and workshops with the utilization of all media for the dissemination of knowledge and information, as an inculcation of enlightened and democratic outlook of the people of India.
  • To strive for the implementation and realization of Sachar Committee Recommendations as also reports of various others committees / commissions formed for this purpose for linguistic minority communities.
  • To provide assistance or loans to deserving persons to help them to settle in life on such terms as the Trustees may think expedient and fit.
  • To work for the overall development and socio-economic freedom of the women in general and to the women belonging to minority communities in particular as running programs like ‘HUNAR’ for the welfare of girls/women belonging to minority communities.
  • To undertake emergency relief works for the victims of flood, fire, famine, earthquake and other disasters. Also to establish Orphanages, Old Age Homes, Child Care Centers and Rehabilitation Centers with special stress on girls and women.
  • To pay to the Government or to any public authority, rent, rates, taxes, assessment dues, duties and outstanding that may from time to time be levelled in respect of the assets of the trust or any part thereof.
  • To take necessary steps for the development of women through education and training so that they recognize their rights and duties and prove themselves useful to the communities, society and the nation. Further to strive for the empowerment of women folk by making them self-employed and financially independent.
  1. To accept any Grant in Aid/fund or donations (either in cash or kind) either from the Government/funding agency/Financial institution/or any Indian or foreign nationals or organisation for being utilized to fulfil the objectives of the trust. The Founder Trustee may deem it proper in larger interest of the Trust without any prejudice and compulsion.
  •  To defray out of the income of the Trust all expenses and other outgoing and incidental funds towards the creation, maintenance, management and administration of the Trust.
  • To invest, dispose of, transfer and otherwise deal with the subject matter of the Trust in such manner as the Founder Trustee in priority or as the board of Trustees may deem it fit and proper to do so in carrying out the objectives of the Trust.
  • To raise or borrow money required for the purpose of the Trust on a mortgage or pledge of the Trust estate or any part thereof with or without any security and as such rate of interest and on such terms and conditions as the founder Trustee may deem fit and proper complying the guidelines of the RBI.
  • To invest the Trust assets in sound and profitable securities and ventures.
  • To acquire by gift, purchase, exchange, lease or hire or otherwise any land, building and any other movable or immovable property and any estate or interest or interests for the furtherance of all or any of the objectives of the Trust.
  • To invest the funds of the Trust with any insurance or securities being authorized under the Income Tax Act or Direct Tax Acts or other applicable laws in force at the given time, in case it is immediately not required depositing with the bank account.
  • To create any reserve fund, sinking fund insurance fund, provident fund or any other fund whether for description or repairs, improving, extending or maintaining any of the properties or rights of the Trust and for recumbent of wasting assets and/or for benefits of employees and for any other purpose for which the Founder Trustees deem it expedient or proper to create to maintain any such fund or funds.
  • To purchase or hire or to take the lease of lands, buildings and other immovable or moveable properties in the name of the Trust.
  • To do all such lawful acts, deeds and things either alone or in conjunctions with other organizations as are incidental or conductive to the attainment of any of the above objects.
  • To take over the management of any other public or charitable institution, project, or branch or any such institution on such terms and conditions as the Founder Trustee may deem fit to manage such institutions.
  • To provide benefits towards the welfare of employees of the Trust and also to sponsor any project works of any institution, establishment whatsoever may deem fit by the founder trustee.
  • To make rules and regulations for the execution and management of the affairs of the Trust and to add/ amend/change/remove or delete such clause/section/point or any of the above mentioned objectives as and when it is needed or required to be done.
  • All the activities being financed from the Trust funds shall be conducted in accordance with the ideals and objectives as stated here, however any particular fund/donation are marked and accepted for any specific purpose, the allocated fund shall be used for such specific purpose.
  • To accept upon the terms as the Board of Trustee may think fit any grant donation or contribution in money, kind of land or other property impressed with the trust to carry out its objectives.
  • To control supervise maintain and manage  all the institutions, establishment of all kinds and execute their functioning, directly or through agencies, committee and other bodies as deemed proper and desirable  by the Founder Trustee or the Board of Trustee.
  • To avail opportunity, facilities and rights granted to institutions of minorities and backwards by the constitution of India with regard to maintenance of the assets of Trust and its different institutions.
  • The Trust shall have the power to implement & execute any programme/activity as considered fit for the development and welfare of human kind in general.
  1. The Trust in pursuit of its inherent aim and objective will extend support to and seek help from like-minded Organizations having similar objectives.
  • To provide the Constitution, rules and regulations and code of conduct and business to all its institutions, establishments running under sponsorship and control of the Trust for smooth functioning, control and guidance.
  • To provide, manage and incur all investment and expenditure to carry out/establishment, conduct and fulfilment of the overall purposes of the Trust and by resolution to act any deed or work according to need of the time.
  • The Trust shall accept charitable funds to address any eventuality being created by natural/human calamities at any point of time.
  • To carry on all other activities ancillary and incidental to the attainment of the objectives.

7. All the activities shall be Non Profitable and shall be done on “No Profit No Loss basis”.

8. All the incomes, earnings, movable / immovable properties of the TRUST shall be solely utilized and applied towards the promotion of its Aims and Objects as set forth in the declaration of the TRUST and no profit thereof shall be paid or transferred directly or indirectly by way of dividend, bonus, profit or in any manner whatsoever to the present or the past member of the TRUST or to any person claiming through any one or more of the present of the past members. No members of the TRUST shall have any personal claim on any movable or immovable properties of the TRUST or make any profits, whatsoever, by virtue of his membership, however they may be paid remuneration and reimbursement of expenses for the valuable work and contribution to the TRUST and its Institutions, if any.

  • That the TRUST Fund may be augmented by the income from the initial fund and also by Donations, Grants, Foreign Contributions and other contribution from time to time.
  1. That the TRUST Fund shall be applied for any purpose other than those specified in this declaration unless the other objects added to the TRUST objectives by resolution.
  1. That the TRUSTEES shall always maintain proper accounts of the TRUST, which shall be kept at the office of the TRUST.

RULES AND REGULATIONS

The name of the TRUST shall be “Hind Life and Education Trust” (HLET).

1.   DEFINITION

In these presents unless there be something in the subject or context inconsistent therewith:

  • TRUST” means the “Hind Life and Education Trust (HLET).
    • “Committee” means the BOARD OF TRUSTEES / Governing Body and other Committee formed time to time.
    • “Year” means the financial years starting from First day of April and ending on 31st day of March of following year.
    • “Act” means The Indian Trust Act, 1882.
    • “Office” means the registered office for the time being of the TRUST.
    • “Month” means calendar month.
    • “Member” means TRUSTEES of the TRUST.
    • TRUSTEES” means member of the BOARD OF TRUSTEES and includes office bearers.
    • “In writing” or “Written” means and includes words, printed, typed, lithographed represented or reproduced in any mode in a visible form.
    • “Secretary” means the Secretary of the TRUST and includes any person appointed to perform the duties of Secretary temporarily.

2. MEMBERSHIP:

Subject to the approval of BOARD OF TRUSTEES, any person residing in India may become a member of the TRUST provided he/she believes in the aims and objectives of the TRUST.

There shall be the following classes of members of the TRUST:

(a) Founder Members:

All those persons who have appended their signature in the Memorandum shall be founder member of the TRUST and shall remain so, for life.  The founder members shall pay ` 10,000/- (Rupees10,000) at the time of formation.

(c) Refusal: –The decision of the BOARD OF TRUSTEES as to the eligibility of a person for membership for the TRUST or to a class of membership shall be final and conclusive. Reasons for the refusal shall be communicated to the applicant.

3. TERMINATION OF THE MEMBERSHIP:

  1. Resigns or dies or becomes of unsound mind.
    1. By a competent court sentenced to imprisonment for any offence involving moral turpitude.
    1. If found by Governing Body to be engaged in activities which are against the interest of the TRUST.
    1. If not attending the three consecutive meetings continuously without any information to the committee.
    1. For any other valid reasons.

4. GOVERNING BODY

Subject to such policy/directions as the BOARD OF TRUSTEES may like to give from time to time, the management of the TRUST shall be vested in and rest with the Governing Body.

a)   There shall be a Governing Body consisting of Seven (7) members including office bearers to be elected by the BOARD OF TRUSTEES in the Meeting of the TRUST.

b)   The members of Governing Body shall hold office for a period of five years.

c)   The members of the Governing Body may fill up any casual vacancy of the committee for the remaining period of the office so held.

d)   The outgoing members of the committee shall be eligible for re-election. There will not be any election for President.

5. COMPOSITION OF THE GOVERNING BODY

The Governing Body shall consist of the following members in order of their names as provided:-

  • Chairman
  • Vice Chairman
  • Secretary
  • Treasurer

6. POWERS, DUTIES AND FUNCTIONS OF THE GOVERNING BODY

Subject to the provisions of the Memorandum of Association and the Rules and Regulations, the Governing Body shall, in addition to other powers vested in it, have the following powers: –

(a) The Governing Body shall be solely responsible for the management of all the affairs of the TRUST and it shall have necessary power for executing decisions of the BOARD OF TRUSTEES and managing the affairs of the TRUST in all respect.

(b) To alienate, sale, take lease, mortgage, pledge, hypothecate, donate the property whether movable or immovable.

(c) To implement programme for the execution of the objective and allied activities of the TRUST and to invest the fund of the TRUST for the works of the TRUST.

(d) To frame such Rules and Bye-laws as it may from time to time consider to be necessary for regulating the management of any institution under the control of the TRUST.

(e) To raise money by way of subscription, donation, grants, foreign contribution, loan etc.

(f) To do all such lawful acts and things as are identical and conducive to the attainment of the objects of the TRUST.

(g) To appoint, transfer and retire the personnel or the employees or other employee related affairs.

(h) The Governing Body may form Committees or Sub-Committees as it may deem necessary for effective functioning of the TRUST and its different units and institutions from amongst the members of the TRUST and also co-opt experts and specialists on such Committees.

(i) All acts done at any meeting of the Governing Body or any of its Committees shall be valid notwithstanding that some disqualification or defect in the appointment of any member of the Governing Body comes to light later.

(j) No act or the proceedings of the Governing Body or any of its committees shall be invalid merely by reason of the existence of vacancy/vacancies or any defect in the co-option, nomination or election of any of its members.

(k) No member of the Governing Body shall be personally or individually answerable for any loss arising in the administration or application of the funds of the TRUST or any damage to or deterioration not caused by a willful default or neglect on his part.

(l) The Governing Body may accept donations and gifts on such terms as may be considered suitable.

(m) Subject to the regulations made by the TRUST, the Governing Body is empowered to make such rules and By-laws as it may consider necessary for its units or institutions provided that any changes in the existing rules and By-laws and new rules and By-laws shall be reported and approved by 2/3 majority of the Governing Body in the meeting or next meeting.

7. POWERS AND DUTIES OF OFFICE BEARERS

CHAIRMAN

a) The Chairman shall preside over all the meetings of the TRUST and all committees or sub-committees.

b) He shall appoint all committees or subcommittee and such special committees, as may be decided by Governing Body.

c) He shall make decisions connected with implementing the policies of the TRUST and decisions made at the annual meeting.

d) He shall submit an annual report in writing to the Governing Body of the TRUST.

e) He shall exercise such financial powers as may be decided by the Governing Body.

f) He shall deal with all the correspondence pertaining to the TRUST.

g) The Chairman shall be chief coordinator of the TRUST and its Units & Institutions and shall supervise the overall their activities.

(h) The Chairman shall establish contact, negotiate and conclude all contracts and agreements.

(i) The Chairman shall also be empowered to approve the expenses for completion of the work decided by the Governing Body.

(j) The Chairman shall exercise control over the employees of the TRUST and its Units & Institutions including the power of the dismissal.

  • The Chairman shall appoint from time to time such and so many employees/active members and on such terms and conditions as may be fit for carrying on the affairs of the TRUST.
    • He shall make sign and execute such documents and instruments as may be necessary for proper carrying on of the affairs of the TRUST and its Units & Institutions.
    • He shall enter into agreements for and on behalf of the TRUST.
    • He shall receive money, securities, instruments and /or any other moveable/immoveable property for and on behalf of the TRUST and its Units & Institutions.
    • He shall manage the properties of the TRUST and its Units & Institutions.
    • He shall prescribe the powers, the functions and duties of the office bearers in consultation with the Governing Body.
    • The Chairman shall handle all the important financial matters himself and if required, he shall hand over the charge to the Secretary or Treasurer for the time being in his absence.

VICE CHAIRMAN

  • In the absence of the Chairman, the Vice-Chairman shall deal all kinds of work, which will be handed over by theChairman.
  • He/She will become the Chairman of the TRUST after resignation or death of the Chairman. Thereafter the Board of Trustees must elect a Chairman.

SECRETARY

  • He will look after day-to-day management of office of the TRUST and shall help Chairman to discharge his duties.
  • He shall keep all records of the TRUST in suitable form and for ready reference.
  • He will convene whenever necessary meetings of the TRUST and of any committee which may be necessary to be called with the consent of the President.
  • He will keep proper minutes of the proceedings of the TRUST meeting, do the register and will do everything to give effect to the resolutions passed by the BOARD OF TRUSTEES / Governing Body meeting of the TRUST.
  • All the documents will be kept only in the office of the Trust.

TREASURER

  1. He shall make arrangement for the maintenance of the accounts of the TRUST.
  2. He shall submit an annual budget before the Governing Body for its approval and his recommendations to the TRUST.
  3. He will be responsible for the proper auditing of the accounts periodically by an Auditor chosen by the BOARD OF TRUSTEES from amongst registered Chartered Accountants.
  4. He shall exercise such financial powers as may be decided by the Governing Body.
  5. He shall issue receipt for all sums received on account of the TRUST under his/her own signature.
  • TERM OF THE OFFICE  OF THE MEMBERS OF THE GOVERNING BODY INCLUDING OFFICE BEARERS: –

The members of the Governing Body shall hold office for 5 years except the President and shall be eligible for re-election. Even after the expiry of their term, the members shall continue to hold office till their duly elected successors are in position.

  • POWER: –

Subject to the regulations made by the TRUST, the Governing Body is empowered to make such rules and By-laws as it may consider necessary provided that any changes in the existing rules and By-laws shall be reported and approved by 2/3 majority of the BOARD OF TRUSTEES in the next meeting.

10. QUORUM AND NOTICE OF MEETINGS

(a) The Governing Body shall meet at least once in three months. The quorum of the meeting shall be two-third members. Ordinarily seven days notice shall be given for the meeting. In case of an emergency, the Secretary may, with the approval of the President, call a meeting of the Governing Body at two days notice. In case the quorum is not complete the meeting shall be adjourned and fixed for any day after the said meeting. No quorum shall be required in the case of adjourned meeting but at least two members shall remain present.

(b) In case of urgency the Secretary may, with the approval of the President, circulate a proposal for decision by circulation, which will be considered as carried, provided that there is 3/4 majority in support of the proposal.

11. VOTING

    Unless otherwise provided by the bye-laws, all disputed questions at a meeting shall be determined by vote. Each member of the TRUST or of the Governing Body, as the case may be, present at the meeting shall have one vote and the majority vote shall prevail. In case of equality of votes, the President shall have a casting vote.

12. ELECTION: –

Election shall be by secret ballot as per the election rules approved by the BOARD OF TRUSTEES.

13.  APPLICATION OF ACT: –

All provisions of The Indian Trust Act, 1882 as applicable to all over India shall apply to the TRUST.

14. FINANCE AND ACCOUNTS

(a) The Accounts of the TRUST shall be kept in the form and on the lines laid down by the Governing Body and shall be audited regularly/annually by a firm of Chartered Accountantsappointed by the TRUST.

  • All moneys received from and on behalf of the TRUST shall be paid / deposited in the appropriate account in the Bank / Banks approved by the Governing Body.
  • All payments would be made by cheque against the bill / memo except for small bills amounting to less than 10,000/- (Rupees ten thousand only).
  • The Annual Reports and the Financial Statements of the TRUST as audited by the Auditors, along with Audit Report, shall be submitted to the Governing Body.
  • Any amount which is to be withdrawn from the Bank be withdrawn by means of a cheque, internet banking or any other mode as provided by the bank to be signed by the person authorized by the Governing Body.
  • To open account in the name of the Trust or its institutions or unit with any Bank, or post office, financial institution etc, to operate such account and to give instructions to the Bank and to provide for opening and operation of such account by one or more of the Trustees or by an agent appointed by the Trustees, through a resolution in this regard.

15. Office and Staff: –

The TRUST shall have its own independent office and shall have its essential staff to be decided by the Governing Body.

16. Legal Proceedings: –

The TRUST may sue or be sued in the name of Chairman and/or such person/persons as shall be appointed by the Governing Body for the occasion as per provisions laid down under The Indian Trust Act, 1882.

17. Movable and Immovable Property: –

All deeds of transfer, lease and other documents relating to the movable and immovable property of the TRUST shall be signed by the Chairman of the TRUST. All documents and records of the TRUST shall be maintained at the premises of the TRUST and or at such other place for safe custody as the TRUST may determine by separate resolution.

18. Funds: –

The TRUST may accept donations, grants, subscriptions, aids or contributions from any person, Government, Local authorities or any other institutions, or any foreign agency or organisation in cash or in kind including immovable property without any encumbrance. While applying such receipts to the objects, the TRUST shall respect the directions, if any, by the donors. Any receipt with specific direction to treat the same as part of the Corpus Fund of the TRUST or a Separate Fund shall be funded accordingly.

19. Irrevocable: –

     This TRUST is irrevocable.
 

20. Amalgamation: –

The TRUSTEES may amalgamate the TRUST with another Charitable TRUST or Institution having similar objects with the approval of the BOARD OF TRUSTEES.

21. Dissolution of the Trust: –

(a) Every member of the TRUST shall in the event of the TRUST being wound up during the time that he is a member, or within one year afterwards, be liable for payment of the costs, charges and expenses of winding up the same, not exceeding ` 1000/- (Rupees one thousand only).

(b) If upon the winding up or dissolution of the TRUST, there remains, after satisfaction of all its debts and liabilities, any property whatsoever, the same shall not be paid to or distributed among the members of the TRUST but shall be given or transferred to some other Institutions / Trust / Society / NGO having objects similar to the objects of this TRUST. No member of the TRUST shall have any personal claim on any movable or immovable properties of the TRUST nor shall make any profits by virtue of his.

22. Jurisdiction of the Court

In respect of the Administration or Other matter of TRUST the dispute shall be referable to the court/Juridical authorities situated at Patna where the activities and functions associated with the TRUST are principally conducted.

We, the undersigned, are desirous of forming a TRUST, namely, “Hind Life and Education Trust” (HLET) under The Indian Trust Act, 1882: –
